Oh Montel... Where in the constitution does it say that our gov should do no harm and be compassionate to all its people. I understand that Reason is pro MJ but you should check your principles first. I am fine with legalization but it needs to be done on a federal level or the whole supremacy clause goes out the window. You know a state can be more but never less restrictive.

Trent, the Supremacy Clause is all well and good, provided the Federal law is valid and constitutional, but I really wish we could put it to a proper federal test that the feds should have any say over marijuana which is grown in California, and then sold in California in accordance with California laws.

The whole point of having a Federal government is to provide a common defense, a national currency, and to regulate interstate commerce. I simply don't see how drug laws enter in to federal jurisdiction.

Trent, you have it exactly wrong: According to the Constitution, states can be LESS, but never MORE, restrictive than the federal government.

So you can assure me that no MJ sold in CA is from outside of CA and therfore exempt from the interstate commerce clause. I am not saying I want a powerful fed I am just saying that the AG's stance opens up some interesting boxes.

For example what if FL decides to legalize child porn. The fed now has no say.

And Geena we both over simplified the supremacy clause, the Supremacy Clause states that the Fed law is the supream law of the land and that states are compelled to up hold it. (i.e. MJ is illegal)
